I had this movie and the disc stopped working, its way out of warranty range. Would it be legal to download a copy from somewhere on the internet for “backup” purposes? The disc skips while playing. I don’t think it’d be possible to use any type of dvd burning program to get a backup since it skips, would it?

There is a lot of misinformation about “downloading.” Usually, people who’ve downloaded copyrighted material have been prosecuted, and the media reports it as “illegal downloading.” In fact, they downloaded that material through a peer-sharing network which, at the same time, also UPloads the material you’ve been downloading.

Uploading copyrighted material is infringement. Same as copying it and handing it out. Doesn’t matter whether it’s for pay or for free, only certain people/companies have been granted permission, and you ain’t one of them.

Anytime you watch anything on the web, you are “downloading” it. Even Youtube, where you have permission to watch it. In order to watch, it must download to YOUR computer and then your software is able to play it. Afterwards, there are still remnants of that download in your computer.

Now, the website is the uploader. It’s uploading it to the internet so that YOU can download it for watching. Maybe the website has permission, maybe not. But that’s the website’s problem. For you to only DOWNload it (not share it by re-uploading it, yourself), you’re in the clear. It’s not even a case of conspiracy or being an accessory, since that requires you to AGREE and plan with the owner of the website to engage in an illegal act. It must be a knowledgeable and willful agreement, not just an accidental one.

In fact, copyright law allows you to make an archival copy for yourself, in case of such a problem as you’ve found. Except that you didn’t, and now it’s too late. Yes, a copying program would not work since the skips would interrupt it.

So, if you can find a copy on the internet, feel free to download it. But make SURE it’s a one-way process. Torrents are two-way, meaning you’re uploading at the same time, and THAT will get you busted.

No, that would not be legal.

Here’s my two cents. I would go on Amazon, buy another copy of said movie that broke. Then also buy some blank DVD-Rs. Then I would get two free programs called DVD Shrink 3.2 and ImgBurn. Use these programs to make a backup of your movie. Then watch the backup(s) and keep the original disc in its case so it doesn’t get ruined.

Making one backup for personal use is not illegal. Making more than one is but they’re not going to find out unless you tell them, and I doubt they would care as long as you’re not handing them out to all your friends.

Yes, if the person or business you are downloading the movie from owns the copyrights to the movie or has permission from the copyright owner. I.E. They have the legal right to give it to you.

No, if you are downloading pirated movies. I.E. Downloading movies from a source that doesn’t own the copyright, or have permission from the copyright holder to disseminate them.

Whether you pay for the download or not has no legal bearing on the legality of the download. The only way to legally download a movie, is to get it from the copyright holder or their duly authorized agent. (that’s the legal mumbo-jumbo.)
