Your Questions About Download Old Movies Songs

Donna asks…

Can you still be traced if you delete the songs you downloaded from limewire?

Recently my mate downloaded some songs from limewire and then got worried that he would be traced and so deleted the songs from his limewire library, even though he deleted the songs can they still trace him to the fact he illegally downloaded some songs or not because he deleted them?

Any answers appreciated as he seems a bit worked up that he’s going to be traced even though he deleted the songs.

Nagesh answers:

You’re caught the minute you download the song. Basically, they monitor files that they know are songs (or movies) under copyright and log the IP addresses of everyone who connects to and downloads them. Once they have a bunch of IPs, they contact the ISP to get the information on the account associated with the IP. Then you have the person’s name and address for filing a lawsuit.

Deleting the files does nothing but make you look even guiltier. There was a case in Minnesota in 2007 where a jury found a woman guilty of illegally downloading 24 songs. They set her fine at a little over $9,000.00 per song, partially because they were angry with her. She replaced her hard drive and tried to convince the jury that the old drive crashed. She thought she was hiding the evidence. The jury was insulted and felt like it proved she knew she was guilty and thought she could get away with it by destroying evidence, so they went with a steep fine to prove a point.

What will happen if I upload a full movie to youtube?

It’s a movie that’s already on DVD so it’s not like its illegal… but is it? Even if I include that I don’t own anything can I still get in trouble on youtube? How much trouble could I get into? Does it matter whether it’s an old movie or new? Any answers would help…

Nagesh answers:

1) It is illegal – it’s copyrighted

2) Putting a disclaimer like, “I don’t own it” means nothing

3) It doesn’t matter if it’s old or new

4) How much trouble can you get into for violating copyrights? Look below:

http://www.newsvine.com/_news/2009/07/27/3076892-jury-awards-675k-in-boston-music-downloading-case

BOSTON — A federal jury on Friday ordered a Boston University graduate student who admitted illegally downloading and sharing music online to pay $675,000 to four record labels.
Joel Tenenbaum, of Providence, R.I., admitted in court that he downloaded and distributed 30 songs. The only issue for the jury to decide was how much in damages to award the record labels.
Under federal law, the recording companies were entitled to $750 to $30,000 per infringement. But the law allows as much as $150,000 per track if the jury finds the infringements were willful. The maximum jurors could have awarded in Tenenbaum’s case was $4.5 million.
Jurors ordered Tenenbaum to pay $22,500 for each incident of copyright infringement, effectively finding that his actions were willful.

Is downloading from my ipod onto my computer illegal without buying a program for it?

My computer got a virus a little while ago, and the old files on my itunes got erased. Now, they only exist on my ipod. I want to put them back on my computer (and I know how to put them back), but I don’t know if I have to have a specific program to do that for. I don’t want to put them on my computer illegally, so I need to know if it’s safe.

Nagesh answers:

First of all nothing is illegal about it
What kind of files?
Are they apps? If yes then don’t worry . While syncing your iPod , an options pops up asking you to transfer apps
If they are songs or movies then use this software- diskaid
Just go to YouTube and search how to transfer files from iPod to pc using diskaid
It isn’t illegal
If they are purchases then just download em’ again it won’t cost you.
Next time create a backup.

How long could someone go to jail for downloading music illegally?

My..friend has download around 40-50 songs with paying for them. Could they go to jail? If so, for how long? Would their parents go to jail if this person was a minor? Would they just have to pay a fine or something?

Nagesh answers:

Jail, no. Fined…yes.

In the USA, 26,000 people have faced civil lawsuits for using P2P file-shareing programs such as Limewire to steal and share copyrighted music, software, movies, etc.

People DO get caught stealing and “sharing” copyrighted “stuff” using P2P filesharing programs such as Limewire, Bearshare, Kazza, Frostwire etc, and face huge fines.

People as young as 12 years old get busted.

Jammie Thomas makes $36,000 a year but says she’s not looking for a handout to pay a $222,000 judgment after a jury decided she illegally shared music online and did it on purpose…Record labels have sued more than 26,000 people they accuse of sharing music online in violation of copyright laws.

Additionally my friend downloaded 10 songs before he got caught and had to fish out 3000 quid, BUT i have known people who have done it there whole life and never get caught.
